WASHINGTON – Osbaldo Aldrete-Davila, the Mexican drug smuggler given immunity to return to the United States and testify against two Border Patrol agents, was involved in smuggling a second load of marijuana into the United States after he was given court protection, records have confirmed.

Newly released transcripts of the trial of Jose Compean and Ignacio Ramos have corroborated WND reports that the Mexican illegal alien was involved in the second drug case, this one involving a load of marijuana brought into the U.S. in October 2005.

The incident followed his grant of immunity by U.S. Attorney Johnny Sutton in return for truthful testimony against Ramos and Compean. The former agents are serving 11 and 12 year prison terms for their actions in a Feb. 17, 2005, incident in which they shot Aldrete-Davila as he was fleeing across the border into Mexico.

Activist organizations have made repeated calls for President Bush to pardon the former agents, who, they say, are being punished for doing their duty.

As WND also has reported Rep. Duncan Hunter, R-Calif., has sponsored a resolution calling for a congressional pardon for Ramos and Compean, and his office confirmed the resolution already has 82 co-sponsors.

Officials urged to resign for lie about border agents

Congressman calls for ouster of DHS deputies after IG admits agency gave false information

A Republican congressman is calling for the resignation of Department of Homeland Security officials who he says lied about the case of two Border Patrol agents imprisoned for their actions in the shooting of a drug smuggler.

As WND reported, at a congressional hearing yesterday, Rep. John Culberson of Texas confronted DHS Inspector General Richard Skinner about his agency's claim it had documentary proof of the guilt of former agents Ignacio Ramos and Jose Compean.

"Richard Skinner admitted yesterday under oath that his top deputies gave members of Congress false information painting Border Patrol agents as rogue cops who were not in fear for their lives and who were 'out to shoot Mexicans,'" Culberson said in a statement.

Culberson said he believes false information was given to congressmen to "throw us off the scent and cover up what appears to be an unjust criminal prosecution of two U.S. law enforcement officers whose job was protecting our country's borders from criminals and terrorists."

The admission came during Skinner's testimony before the Homeland Security Subcommittee of the House Appropriations Committee. Culberson was asking questions about a meeting DHS officials had Sept. 26 with him and three other Republican congressman from Texas, Reps. Ted Poe, Michael McCaul and Kenny Marchant.

Ballistics data don't support charge against border agents

Ballistics data don't support charge against border agents
Investigator: U.S. attorney twisted evidence to fit case – 'guilty of malicious prosecution'

Ballistics reports, used in the trial of Ignacio "Nacho" Ramos, one of two Border Patrol agents convicted of shooting fleeing drug dealer Osbaldo Aldrete-Davila, do not support the prosecution's claim the bullet was fired from Ramos' gun, according to documents provided to WND from Andy Ramirez, chairman of the Friends of the Border Patrol.

Despite the conclusion of a laboratory criminalist that he could not conclusively link the bullet removed from Aldrete-Davila with Ramos' service weapon, a Department of Homeland Security agent swore, in an affidavit of complaint filed against Ramos and Jose Alonso Compean, that Aldrete-Davila was hit by a round fired by Ramos.

"Johnny Sutton and his assistants are guilty of malicious prosecution," Ramirez charged to WND. "The prosecutors lied to the jury and he twisted evidence to make it fit his case. And when he couldn't twist the evidence, the government demanded that the court seal evidence which would have been exculpatory to the defense."

Nearly two years after the conclusion of the trial, the U.S. District Court for the Western District of Texas has yet to release a transcript of the trial.

WND asked Ramirez if he was aware of the seriousness of his charges.

"I am very aware and I am accusing Mr. Sutton of a felony," Ramirez told WND, "but I am basing my conclusion on the evidence I have examined in this case and the refusal by the government to provide evidence to substantiate its claim to the Congress and the American people."

"Back on Sept. 26, 2006, officials from the DHS Office of Inspector General made serious allegations against both agents Ramos and Compean to four members of Congress from the Texas delegation," Ramirez said. "The Inspector General has subsequently refused to provide their evidence to substantiate their claims to Congress. So I am also accusing the DHS Office of Inspector General of making false statements to Congress in order to prevent a congressional inquiry. I am asking the U.S. Congress to subpoena all documents pertaining to this case including the full transcripts, sealed testimony, and the sealed indictment against Aldrete-Davila in order to get to the truth of this case once and for all."

Border Patrol agent held in solitary confinement

Border Patrol agent held in solitary confinement
'They act like he's Charles Manson,' father-in-law tells WND

Imprisoned former Border Patrol agent Ignacio Ramos not only is being held in prison for trying to halt a fleeing drug smuggler, he's being held in solitary confinement treated as if he were Charles Manson, a relative told WND in an exclusive interview.

Joe Loya, Ramos' father-in-law, told WND that Ramos is being held in conditions usually reserved for extraordinarily dangerous or trouble-making inmates.

"They have Ignacio in a 6 foot by 12 foot cell," Loya told WND in a telephone interview from El Paso. "There are no bars, just a steel door, and no window. He has no television and nothing to do. He is fed in his cell and let out only for one hour after 23 hours in the cell. He is then taken to a room with a television where he is allowed to watch the TV for an hour before he is returned to solitary confinement."

Loya said his daughter met with her husband for an hour on Friday.

"Ignacio was heavily shackled," Loya said, "and he could barely hold the telephone to speak."

Loya explained that his daughter met with her husband in the prison in a room where they were separated by a glass barrier.

"It was just like Ignacio was Charlie Manson," Loya explained. "My daughter couldn't believe how her husband was being treated."

Loya told WND that the family believes that the federal prosecutor, U.S. Attorney Johnny Sutton, introduced into the trial inaccurate or incomplete testimony provided by the drug dealer, Osbaldo Aldrete-Davila, as well as from other Border Patrol agents who the federal prosecutors had pressured prior to the trial.

"I can't believe how Ignacio is being treated," Loya told WND. "He has been a federal agent for years and he has been involved in many drug busts. I am convinced that the U.S. attorney has a grudge against my son-in-law and I cannot believe how mean and determined Johnny Sutton has been to see my son imprisoned for doing nothing more than trying to stop a drug smuggler he and Jose Compean believed was armed and dangerous."

Special counsel sought for imprisoned border agents

Special counsel sought for imprisoned border agents
Head of union wants probe of case against 'innocent men doing their job'

The head of a union representing most Border Patrol agents is calling on President Bush and Congress to appoint a special counsel to investigate the case of agents Ignacio Ramos and Jose Alonso Compean, who began prison sentences yesterday for shooting a Mexican drug smuggler.

TJ Bonner, president of the National Border Patrol Council, which represents 60 percent of the nation's agents, called the convictions an outrage.

"This case involves two innocent men doing their job, trying to secure our borders," he told WND. "They were defending themselves against an armed drug smuggler, and yet they end up in prison. How is that possible?"

On Tuesday, federal Judge Kathleen Cardone of El Paso, Texas, denied Ramos' and Compean's contention they were not a flight risk and rejected their motion to stay out of prison on bond while they appeal their case to the 5th Circuit Court of Appeals in New Orleans.

Bonner told WND the agents' imprisonment will have a detrimental effect on the willingness of Border Patrol agents to go out and enforce immigration laws.

"The Bush administration is sending a message to all law enforcement officers," Bonner told WND, "that it is to be 'hands off the border, leave it wide open, don't you dare do your jobs or you too will end up in federal prison.' "After this travesty of justice," he continued, "why would any Border Patrol agent stick their neck out trying to apprehend a Mexican drug smuggler, especially when you realize that you could be the one who ends up behind bars?"

The Bush administration continues to argue on background that Ramos and Compean lied to Border Patrol officials and covered up evidence, asserting the Mexican drug smuggler was not armed and had attempted to surrender peacefully.

Bonner disagrees, arguing there were "only three people who saw what happened on the other side of that levee – Agent Ramos, Agent Compean, and the Mexican drug smuggler, Osbaldo Aldrete-Davila."

"The agents testified that the drug smuggler did not have his hands up, that he was running away, and that he pointed an object at them that they believed to be a gun. So, the agents opened fire," Bonner said. "Essentially, what the White House is saying is that they believe the word of a drug smuggler over the word of two sworn federal agents."

A Border Patrol agent sentenced to prison along with his partner for shooting and wounding a man smuggling drugs into the U.S. will appear with a congressman tomorrow at a rally asking President Bush to offer a pardon.

Jose Alonso Compean and Ignacio Ramos, were sentenced to 12 years and 11 years, respectively, in October by U.S. District Court Judge Kathleen Cardone in El Paso, Texas. The drug smuggler was granted immunity for his testimony.

Compean will be joined by family; Rep. Dana Rohrabacher, R, Calif.; Minuteman Project founder Jim Gilchrist; and members of other border-security groups such as Friends of the Border Patrol at the courthouse in Santa Ana, Calif., at 10:30 a.m. Pacific time tomorrow.

Rohrabacher, noting the president already has received a letter about the case from more than 50 Congress members, is asking Americans to sign petitions and send e-mails and letters to the White House requesting a "Christmas pardon."

Grassfire.org has an online petition calling on Bush to pardon the agents, with more than 130,000 signatures.

"This is the greatest miscarriage of justice that I've seen in my career," Rohrabacher told WND. "Two brave Border Patrol agents trying to enforce the president's nonsensical border policy ending up being sent to prison, while an illegal alien drug smuggler is given immunity and walks free."

Compean's sister, of Huntington Beach, lives in Rohrabacher's Southern California district.

The White House has not responded to the letter, according to Rohrabacher, and did not follow up a request from WND for comment. Press secretary Tony Snow has said he cannot comment on presidential pardons.

Gilchrist said what has happened to the two agents is "atrocious," with "their lifes being ruined, their families being put in turmoil."

"We would expect the president to give a full and unconditional pardon to these two wrongly arrested, wrongly accused, wrongly convicted members of law enforcement," he told WND, "and retroactive pay and benefits they've lost over the past two years since they were originally arrested."

As WND has reported, a federal jury convicted Compean, 28, and Ramos, 37, in March after a two-week trial on charges of causing serious bodily injury, assault with a deadly weapon, discharge of a firearm in relation to a crime of violence and a civil rights violation.

Ramos is an eight-year veteran of the U.S. Naval Reserve and a former nominee for Border Patrol Agent of the Year.

On Feb. 17, 2005, Ramos responded to a request for back-up from Compean, who noticed a suspicious van near the levee road along the Rio Grande River near the Texas town of Fabens, about 40 miles east of El Paso. A third agent also joined the pursuit.

Fleeing was an illegal alien, Osbaldo Aldrete-Davila of Mexico. Unknown to the growing number of Border Patrol agents converging on Fabens, Aldrete-Davila's van was carrying 800 pounds of marijuana.

Aldrete-Davila stopped the van on a levee, jumped out and started running toward the river. When he reached the other side of the levee, he was met by Compean who had anticipated the smuggler's attempt to get back to Mexico.

"We both yelled out for him to stop, but he wouldn't stop, and he just kept running," Ramos told California's Inland Valley Daily Bulletin.

"At some point during the time where I'm crossing the canal, I hear shots being fired," Ramos said. "Later, I see Compean on the ground, but I keep running after the smuggler."

At that point, Ramos said, Aldrete-Davila turned toward him, pointing what looked like a gun.

"I shot," Ramos said. "But I didn't think he was hit, because he kept running into the brush and then disappeared into it. Later, we all watched as he jumped into a van waiting for him. He seemed fine. It didn't look like he had been hit at all."

The U.S. government filed charges against Ramos and Compean after giving full immunity to Aldrete-Davila and paying for his medical treatment at an El Paso hospital.

The U.S. Attorney's Office for the Western District of Texas issued a statement in September arguing "the defendants were prosecuted because they had fired their weapons at a man who had attempted to surrender by holding his open hands in the air, at which time Agent Compean attempted to hit the man with the butt of Compean's shotgun, causing the man to run in fear of what the agents would do to him next."

The statement said, "Although both agents saw that the man was not armed, the agents fired at least 15 rounds at him while he was running away from them, hitting him once."

Andy Ramirez of Friends of the Border Patrol said the drug smuggler has "fully contributed to the destruction of two brave agents and their families and has sent a very loud message to the other Border Patrol agents: If you confront a smuggler, this is what will happen to you."

The letter to Bush included the signatures of Rep. Walter Jones, R-N.C., Rep. Pete Sessions, R-Texas, Rep. Ted Poe, R-Texas, Rep. Dana Rohrabacher, R-Calif., Rep. Dan Burton, R-Ind., Rep. Ginny Brown-Waite, R-Fla., Rep. Gary Miller, R-Calif., Rep. Sue Myrick, R-N.C., Rep. Ed Royce, R-Calif., Rep. Steve King, R-Iowa, Rep. Virgil Goode, R-Va. and Rep. Tom Tancredo, R-Colo., the chairman of the House Immigration Reform Caucus.

"We ask that a full investigation of this case be ordered immediately," the letter said. "We are confident that during such an investigation you will find that these Border Patrol agents were acting within the scope of their duty and were unjustly prosecuted. Also, we ask that you use your power of presidential pardon, as granted by the United States Constitution in Article II, Section 2, to pardon these two Border Patrol agents. We understand these requests usually are for those that have already completed their sentences; however, we feel in this case it would be a miscarriage of justice to send these two Border Patrol agents to prison for protecting our nation's borders from an illegal drug smuggler."
